What is Section 7 of the Arbitration and Conciliation Act? Section 7 defines what constitutes a valid arbitration agreement . It states that: “An arbitration agreement is an agreement by the parties to submit to arbitration all or certain disputes which have arisen or which may arise between them in respect of a defined legal relationship, whether contractual or not.”  Elements of a Valid Arbitration Agreement To be enforceable under Section 7, an arbitration agreement must meet the following criteria: Written Agreement : The arbitration agreement must be in writing. Mutual Consent : All parties must voluntarily agree to resolve disputes through arbitration. Defined Legal Relationship : There must be a legal relationship (contractual or otherwise).
